1. Scope and Purpose
These Terms apply to the process through which a user submits Standard Verification, Additional Verification (Enhanced Due Diligence, EDD) or other identity verification materials to ATTEX (the “Platform”). The Platform identifies, verifies, records and continuously manages user identity information in accordance with applicable digital asset service regulation, AML/CFT, sanctions compliance, consumer protection and personal data protection requirements.
Standard Verification is the basic identity verification required before all users may access the Platform’s basic functions. Once Standard Verification is approved, the user may access deposits, withdrawals, trading, fiat deposits and withdrawals and other basic platform functions in accordance with Platform rules. Additional Verification is not a user-selected upgrade and does not represent additional user benefits; it is initiated only by compliance or risk control personnel when specific risk rules, abnormal transactions, manual sampling, compliance review requirements or regulatory requirements are triggered.
2. Information Required from Users
Basic identity information: name, date of birth, nationality, country or region of residence, contact details and account identifiers;
Document information: document type, issuing country or region, document number, expiry date, document image or scanned copy;
Risk information: work status, industry, source of funds, source of wealth, trading purpose, expected transaction volume, PEP declaration and other information reasonably required by the Platform;
Additional Verification materials: handheld document photo, authorization letter, proof of address, source-of-funds evidence, source-of-wealth evidence, transaction explanations or other materials reasonably required by the Platform for enhanced due diligence.
3. User Representations and Warranties
All information and materials submitted by the user are true, accurate, complete and valid, and are not impersonated, forged, altered, concealed or misleading.
The user opens and uses the account for themselves and will not act on behalf of others, lend the account to others or use the account to evade regulation, sanctions, transaction monitoring or Platform risk controls.
The user understands that false, incomplete, expired or inconsistent information may result in failed verification, account restrictions, trading suspension, fund freeze, forced re-verification, regulatory reporting or law enforcement assistance.
The user must promptly update verification information if identity information, document validity, country of residence or risk profile materially changes.
4. Platform Review and Processing
The Platform may process verification applications using manual review, automated rules, third-party providers, OCR, facial verification, biometric checks, sanctions lists, PEP lists, adverse media, KYT or blockchain risk tools. The Platform may require resubmission, Additional Verification or manual review.
System-generated results do not directly constitute the final review conclusion. OCR failure, information mismatch or facial verification failure may be submitted as risk signals to compliance personnel for review. Based on the review result, the Platform may approve, reject, request Additional Verification, apply manual override approval, restrict account functions or take other compliance measures.
5. Recordkeeping and Regulatory Assistance
The Platform may retain verification records, review records, operational logs, risk tags, materials submitted by the user and provider responses in accordance with the laws of El Salvador and other applicable jurisdictions, regulatory requirements, audits, dispute resolution and AML/CFT obligations.
Such records may be provided to the National Commission of Digital Assets of El Salvador (CNAD), the Financial Intelligence Unit (UIF), courts, law enforcement authorities, regulators or authorized third-party providers where permitted or required by applicable law.
6. Governing Law, Jurisdiction and Dispute Resolution
Unless otherwise required by mandatory applicable law, these Terms and any matters arising from identity verification, Additional Verification, review results, account restrictions, processing of user materials or related disputes shall, in principle, be governed by the laws of the Republic of El Salvador.
If the user has any objection regarding identity verification, review results, processing of materials or account restrictions, the user should first submit the matter through the customer support, complaints, privacy or compliance contact channels published by the Platform. The Platform shall receive and handle the user request within a reasonable period.
If the dispute cannot be resolved through consultation, and unless mandatory applicable law provides otherwise, the relevant dispute may be submitted to the competent courts or competent authorities of the Republic of El Salvador. This clause does not restrict the user from filing complaints, reports or rights requests with CNAD, UIF, competent personal data protection authorities, consumer protection authorities, courts, law enforcement authorities or other competent authorities in accordance with law.
